Hester Peirce calls for congressional clarity to fix crypto regulation chaos in the U.S.

SEC Commissioner Hester Peirce urges Congress to clarify crypto regulation roles and eliminate overlapping jurisdictions to support innovation and legal certainty.

As the United States struggles to find regulatory balance in the digital asset industry, SEC Commissioner Hester Peirce has stepped forward with a clear message: the current regulatory overlap is creating confusion, legal uncertainty, and operational burdens that threaten innovation. Speaking at the DC Blockchain Summit on March 26, 2025, Peirce warned that the fragmented landscape of crypto oversight requires urgent congressional intervention.

Her speech highlighted a deep-rooted problem that has plagued U.S. crypto markets for years—too many agencies with competing mandates and no coherent legal framework to reconcile them.

A web of regulators without coordination

According to Peirce, the problem isn’t a lack of regulation, but rather too much of it. From the SEC and CFTC to FinCEN, banking regulators, state-level authorities, and even foreign jurisdictions, the digital asset industry is caught in a tangled web of oversight.

She explained that when multiple entities claim authority over the same space, the result is inefficiency, uncertainty, and legal risks for both regulators and industry participants. In her words, this overlapping jurisdiction can “strain the brains, bank accounts, and briskness” of everyone involved in the ecosystem.

This fragmentation leads to more than just confusion—it discourages compliance, complicates product development, and deters innovation. For startups and developers, navigating conflicting expectations from multiple agencies is not only expensive but often paralyzing.

The need for legislative action

Peirce’s solution is clear: Congress must step in and clarify the responsibilities of each regulatory agency. Rather than creating new institutions or authorities, she advocates for a more streamlined approach that builds upon existing regulators, such as the SEC and CFTC.

In her view, Congress should establish a coordinated framework that identifies who regulates what, and in which scenarios. This clarity would reduce redundancy, prevent turf wars, and give the industry a much-needed foundation for growth.

Moreover, Peirce argued that federal regulation should take precedence in areas where there is friction between state and federal authorities. A unified national policy, she suggested, would prevent fragmentation and ensure consistency across all 50 states.

Cross-agency recognition and market structure

Peirce also addressed how Congress could smooth regulatory friction by allowing agencies to recognize each other’s domains under certain conditions. For instance, if a crypto asset is initially issued under an SEC-approved framework—such as a safe harbor—it should be allowed to trade on a CFTC-regulated secondary market platform, as long as the asset itself does not meet the definition of a security.

This approach would enable seamless market activity without constant regulatory interference or disputes over definitions. It would also promote interoperability between platforms and reduce the regulatory burden on legitimate projects that wish to operate transparently.

By clearly defining what constitutes a security and what doesn’t, Congress could finally resolve the long-standing debate that has prevented widespread institutional adoption and mainstream integration of crypto products.

A voice for decentralization and peer-to-peer markets

Another central theme in Peirce’s remarks was the need to preserve the freedom for individuals to interact directly via peer-to-peer platforms. She emphasized that regulation must not stifle open software development or criminalize the act of building decentralized tools that allow users to transact freely without intermediaries.

In her words, “protecting people’s ability freely to interact directly with one another, including through software,” is essential for maintaining checks and balances in a space increasingly dominated by centralized platforms.

She framed this argument not only as a market principle but as a constitutional one, invoking First Amendment protections for developers whose code facilitates direct interaction and economic autonomy.

This perspective is particularly relevant as regulators around the world increasingly target decentralized applications and protocols under the same legal lens as centralized service providers.

A different tone under the new SEC leadership

The broader context for Peirce’s proposals is a shifting regulatory climate in Washington. Since the beginning of 2025, the SEC under the Trump administration has moved away from the enforcement-heavy stance that characterized previous years.

Several crypto investigations launched during the Biden era have been rolled back, and the agency is now focusing on public engagement and roundtable discussions. Topics include the security status of tokens, trading platforms, custody solutions, and decentralized finance protocols.

This more conciliatory approach signals a possible turning point in how U.S. regulators interact with the crypto space. Peirce’s comments reflect this evolution, promoting transparency, practical solutions, and a regulatory path that supports rather than restricts innovation.

A moment of opportunity for legislative clarity

Peirce’s address wasn’t merely a critique of the current system—it was a call to action. By placing the responsibility on Congress to establish a clear, practical, and innovation-friendly framework, she provided a roadmap for resolving a regulatory mess that has hindered the U.S. crypto sector for far too long.

For years, the absence of comprehensive crypto legislation has forced regulators to apply outdated financial rules to a new digital economy. This has created confusion, litigation, and policy inconsistency that continues to push innovation offshore.

If Congress acts on Peirce’s recommendations, it could lay the groundwork for a more rational and adaptive approach to crypto regulation. One where the rules are clear, enforcement is fair, and developers can build with confidence—knowing that the law supports their efforts rather than obstructs them.

The message from Hester Peirce is both urgent and constructive: the U.S. needs clarity, not more complexity. The crypto industry cannot thrive in a landscape where regulators overlap, contradict, and compete. With clear legislative guidance, the U.S. has the opportunity to become a global leader in digital asset innovation.

But until Congress acts, the confusion will continue—and so will the risk of losing a transformative industry to jurisdictions that move faster and legislate smarter.
