GENIUS Act reshapes stablecoin landscape and fuels DeFi growth

The United States has taken a decisive step toward regulating stablecoins with the passage of the Guiding and Establishing National Innovation for US Stablecoins (GENIUS) Act. This new legislation, supported by bipartisan votes, introduces strict guardrails to ensure that neither Big Tech giants nor major banks can monopolize the stablecoin market. The United States has taken a decisive step toward regulating stablecoins with the passage of the Guiding and Establishing National Innovation for US Stablecoins (GENIUS) Act. This new legislation, supported by bipartisan votes, introduces strict guardrails to ensure that neither Big Tech giants nor major banks can monopolize the stablecoin market. According to Dante Disparte, Chief Strategy Officer of Circle, the GENIUS Act provides both structural clarity and a level playing field, while positioning the US dollar as a dominant force in the global digital currency race.

A closer look at the GENIUS Act

The GENIUS Act introduces stringent requirements for any non-bank entity looking to issue dollar-backed tokens. Companies such as tech conglomerates must create separate entities that function similarly to Circle, adhering to antitrust rules and facing a Treasury Department committee empowered to veto any launch.

Banks are also subject to rigorous oversight. Any financial institution wishing to issue stablecoins must do so through a legally distinct subsidiary. Moreover, the stablecoins must be held on a balance sheet with zero risk exposure—meaning no lending, no leverage, and no risk-taking. This framework is even more conservative than some deposit-token models currently explored by major Wall Street institutions like JPMorgan.

Disparte emphasized that these measures ensure long-term stability and consumer protection. “The biggest winners here are US consumers, market participants, and ultimately the US dollar,” he explained during an interview on the Unchained podcast.

Why this regulation matters

Stablecoins have long operated in a regulatory gray area in the US, raising concerns about consumer safety, systemic risks, and competition with traditional banking. The GENIUS Act not only sets clear operational rules but also introduces penalties for unbacked or fraudulent stablecoin projects, effectively shutting the door on “experiments” like Terra’s ill-fated algorithmic coin.

The law also enforces full transparency by requiring robust disclosures from issuers. For entities managing less than $10 billion in assets, state-level money transmitter regulations will still apply. However, any issuer surpassing this threshold must obtain a national trust-bank charter, placing them under stricter federal oversight.

The controversial ban on yield

One of the most debated aspects of the GENIUS Act is its prohibition on interest-bearing stablecoins. Critics argue that this restriction could discourage adoption by removing one of the main incentives for holding stablecoins—passive income. While this rule aims to prevent bank-like risk-taking, it also creates a competitive advantage for non-US issuers that are not bound by such regulations.

Disparte defends the ban, suggesting that yield should emerge from decentralized finance (DeFi) protocols rather than from stablecoin issuers themselves. According to him, stablecoins should serve as the “base layer of trust,” while yield products should be layered on top by decentralized applications once a robust foundation is in place.

DeFi as the new frontier

The ban on yield-bearing stablecoins could unintentionally accelerate the growth of DeFi platforms. Analysts like Nic Puckrin and Christopher Perkins of CoinFund believe that the absence of yield within centralized stablecoins will push both retail and institutional investors to explore on-chain DeFi opportunities, particularly those built on Ethereum.

Ethereum remains the undisputed leader in total value locked (TVL) across DeFi protocols, making it the natural destination for capital seeking higher returns. As traditional stablecoins lose their yield appeal, decentralized protocols offering staking, lending, and liquidity pool rewards could witness a surge in adoption and liquidity.

Institutional investors, in particular, stand to drive this trend. Unlike retail traders, institutions are bound by fiduciary duties to generate returns for clients. Without interest-generating stablecoins, DeFi’s yield strategies may become increasingly attractive—albeit with their own set of risks and complexities.

Global impact and competition

The GENIUS Act could also shape the competitive landscape between US-issued stablecoins and foreign players. While the act strengthens the credibility of US digital assets by enforcing strict regulations, it might also open the door for non-US stablecoins to gain traction with features that US issuers can no longer provide, such as yield.

In this sense, the GENIUS Act is both a stabilizing force and a potential competitive challenge. However, the US dollar-backed stablecoins are likely to remain a preferred choice for institutional investors due to their regulatory clarity and alignment with American financial infrastructure.

What this means for Circle and USDC

Circle, the issuer of USDC, stands to benefit significantly from the GENIUS Act. The company already operates under a transparent and conservative model that aligns with the act’s requirements. With stricter barriers for tech giants and banks, Circle could further solidify its position as one of the leading stablecoin providers in the US market.

This legislation could also act as a catalyst for broader USDC adoption across DeFi protocols, payments systems, and cross-border settlements. By reinforcing trust and compliance, Circle may gain a competitive edge in both domestic and international markets.

Looking ahead

The GENIUS Act marks a pivotal moment for the future of digital currencies in the United States. By introducing a clear regulatory framework, it balances the need for innovation with consumer protection and market stability. While the yield ban may push some users toward DeFi, this dynamic could foster a more diversified and resilient digital finance ecosystem.

For investors, this is an important moment to evaluate how stablecoins and DeFi protocols will coexist under the new regulatory environment. As the industry evolves, the combination of compliant stablecoins and decentralized yield-generating platforms could create a powerful synergy that redefines digital asset adoption in the years ahead.
