FTX Recovery Trust withdrawal reignites creditor tensions amid global payout uncertainty

The long and complex saga of the FTX bankruptcy has taken another unexpected turn. The FTX Recovery Trust, created to distribute recovered funds to creditors, has officially withdrawn its controversial motion that sought to restrict payouts to creditors from certain jurisdictions — including China, which alone accounts for more than $380 million in claims.

While the withdrawal is being hailed as a partial victory by affected creditors, it may only be a temporary pause. The trust explicitly stated it “may refile the motion” at a later date, depending on evolving regulatory and procedural considerations. For thousands of international creditors waiting for restitution, this latest development adds both relief and renewed uncertainty to an already prolonged process.

The origins of the restricted countries motion

In early July, the FTX Recovery Trust filed a motion asking the U.S. Bankruptcy Court to block or delay creditor distributions in nearly 49 countries, citing regulatory barriers and unclear crypto laws. The list included jurisdictions such as China, Saudi Arabia, Russia, and Ukraine, all classified as “restricted foreign jurisdictions.”

The Trust argued that these restrictions were necessary to comply with local sanctions and ensure legal clarity in executing repayments under U.S. law. However, the proposal sparked outrage among creditors, many of whom argued it unfairly discriminated against international participants and violated the principle of equal treatment among claimants.

Within weeks, more than 70 formal objections were filed in court, led by creditor representatives like Weiwei Ji and Sunil Kavuri, who accused the Trust of attempting to exclude major creditor groups under the guise of compliance.

A win — but a cautious one — for creditors

On November 4, the FTX Recovery Trust filed a notice withdrawing its motion “without prejudice”, meaning it reserves the right to bring it back. The notice also clarified that if the Trust decides to renew the motion, it must file it again under standard bankruptcy procedures and notify all stakeholders accordingly.

For creditors, particularly those in China and Asia, the decision brought immediate relief — but not total comfort. Creditor advocate Weiwei Ji described it as a “temporary victory”, warning that celebrations are premature until actual repayments are confirmed.

“This is a win for all affected creditors, but vigilance is essential,” Ji said on X. “Until compensation is received, unity remains the only protection.”

The withdrawal may reflect growing judicial pressure and community backlash rather than a change in the Trust’s overall stance. Legal analysts suggest that the Trust could reintroduce a similar proposal later, once it has refined its compliance justifications and coordinated with international regulators.

The global implications of selective payouts

The original motion was not just a procedural issue — it represented a potential precedent for future crypto bankruptcy cases. If approved, it would have allowed bankruptcy estates to exclude entire jurisdictions from repayment lists based on local regulatory conditions.

Such an outcome would have sent a chilling signal to global crypto participants, suggesting that creditor rights might vary depending on nationality or residence — a sharp contrast to the decentralised ideals underpinning blockchain finance.

The situation also underscores a deeper issue: the tension between U.S. bankruptcy law and international digital asset regulation. Many countries still lack frameworks for recognising crypto as legal property, complicating recovery efforts and leaving creditors vulnerable to exclusion.

For instance, while China bans domestic crypto trading, Chinese individuals and firms remain heavily involved in global crypto markets. Blocking its creditors from FTX distributions could have triggered international disputes and cross-border legal challenges.

Fiat repayments versus crypto losses

Even as the restricted country motion fades (for now), concerns about repayment value persist. The FTX estate has repeatedly highlighted that its planned 143% fiat repayment may sound generous but fails to compensate for crypto-denominated losses.

During the 2022 market crash, Bitcoin was trading near $16,000 — less than one-sixth of its current price above $104,000, according to data from CoinGlass: https://www.coinglass.com. That means creditors will receive repayments based on old valuations, not current market prices, effectively losing the upside potential of crypto recovery.

Sunil Kavuri, a leading creditor advocate, argued that “FTX creditors are not whole”, noting that repayments in fiat currency erase the compounding value that digital assets have accumulated since the collapse. For many, this issue feels like a second betrayal — after losing their funds, they now risk losing the rebound they could have benefited from if assets were returned in kind.

Legal strategy or optics management?

Legal experts believe the Trust’s withdrawal may be more about optics than substance. With the crypto community closely monitoring proceedings, the Trust could have faced reputational damage if perceived as excluding specific nations without sufficient legal justification.

“This move looks tactical,” one bankruptcy lawyer explained. “The Trust can pause, gather more international support, and refile a stronger version later. It’s not over; it’s just delayed.”

Meanwhile, the FTX estate continues its efforts to liquidate non-core assets and convert holdings into stable currencies to prepare for eventual creditor distributions. However, each delay adds frustration for victims still waiting nearly two years after the exchange’s dramatic collapse.

Rebuilding credibility amid uncertainty

The broader takeaway from the FTX Recovery Trust withdrawal is the fragile balance between compliance, fairness, and perception. Crypto bankruptcies are becoming stress tests for how the global financial system handles decentralised wealth under centralised legal frameworks.

The FTX case, involving over 9 million customer accounts and more than $8 billion in liabilities, remains a landmark in the evolution of crypto jurisprudence. Its outcomes will likely shape how future insolvencies — from exchanges to DeFi protocols — navigate international boundaries, creditor rights, and regulatory complexity.
